Samarkan Pastoral Co Pty Ltd (A.C.N 005 246 640) trading as Coombe Yarra Valley

(“Coombe Yarra Valley” or “we”)

And

The holder of this gift card

(“Customer” or “you”)

Definitions

In these Terms and Conditions, unless a contrary intention appears, the following terms have the following meaning:

1. “Products” means any alcoholic beverages that are sold by Coombe Yarra Valley to customers.

1. “Restaurant” means the restaurant which Coombe Yarra Valley operates on the Site.

1. “Terms and Conditions” means these terms and conditions.

1. “Tours” means any tours which Coombe Yarra Valley offers for sale to customers. Without limiting the generality of this definition, this includes tours of Melba’s Garden and Coombe Cottage which Coombe Yarra Valley offers for sale to customers.

3770. “Site” means the site at 673 - 675 Maroondah Highway, Coldstream VICTORIA 3770.

Operative provisions.

The Customer agrees to these Terms and Conditions when they purchase, activate, redeem, enquire, use and/or attempt to use this gift card.

1. A gift card is of no value unless activated in Coombe Yarra Valley’s system and unless payment for the gift card has been made by the Customer.

2. This gift card is valid for three (3) years from the date of purchase. This gift card cannot be replaced after expiry. Any balance remaining on this gift card after the expiry date will not be able to be redeemed by the gift card holder.

3. Coombe Yarra Valley’s system will be conclusive evidence of the balance, history and expiry date of this gift card.

4. The Customer must be an adult aged eighteen (18) years and older in order to be able to purchase a gift card. Coombe Yarra Valley reserves its right to request the Customer to provide proof of age documents at any time, for the purpose of confirming the Customer’s compliance with this requirement.

5. This gift card can be redeemed for all Products and Tours that are sold by Coombe Yarra Valley. This gift card may also be redeemed in the Restaurant.

6. In order to be able to redeem this gift card for Products in the nature of alcoholic beverages that are sold by Coombe Yarra Valley, the Customer must be eighteen (18) years of age or older. Coombe Yarra Valley reserves its right to request the Customer to provide proof of age documents at any time, for the purpose of confirming the Customer’s compliance with this requirement.

7. Coombe Yarra Valley does not permit the use of gift cards in connection with any special promotional without the prior written consent of Coombe Yarra Valley (such consent which we may give or withhold in our absolute discretion).

8. If the Customer’s purchase exceeds the value of the gift card, the Customer must pay the difference by cash, debit card or credit card.

9. This gift card cannot be used to purchase other gift cards.

10. This gift card cannot be redeemed for cash, returned for a refund or have its balance consolidated to a new card.

11. This gift card cannot be exchanged for a different brand, denomination or type of gift card.

12. No change will be given on the unused portion of this gift card, and any balance on this gift card may only be used in whole or in part against future purchases.

13. This gift card is not legal tender, an account card, a credit or debit card or a security.

14. If the Customer returns any Products which they have purchased using a gift card (in accordance with Coombe Yarra Valley’s returns policy), the amount refunded will be credited to the Customer as a credit note and may be redeemed against subsequent purchases.

15. The Customer is responsible for the use and safety of their gift card at all times.

16. Gift cards cannot be replaced or honoured if lost, stolen or destroyed.

17. Coombe Yarra Valley reserves the right to reject any gift card that has been altered, photocopied or tampered with in any way, or that we otherwise regard as being unacceptable (acting reasonably).

18. This gift card will only be reissued, refunded or honoured where it is shown to be faulty or damaged due to the fault of Coombe Yarra Valley, or where there has been a breach of any condition or warranty implied under the Australian Consumer Law.

19. Where the Customer purchases this gift card as a personal or business gift, or for other business uses approved by Coombe Yarra Valley, the Customer must ensure that the end gift card holder is made aware of these Terms and Conditions.

20. To the maximum extent permitted by law, Coombe Yarra Valley is not liable to any person for any loss and damage (including direct or consequential loss), nor will Coombe Yarra Valley be in default of these Terms and Conditions for failure to observe or perform any of its obligations hereunder, for any reason or cause that could not, with reasonable diligence, be controlled or prevented.

21. Coombe Yarra Valley may collect personal information at the time of redemption or purchase of this gift card. Persons subject to these Terms and Conditions consent to the use of their personal information in accordance with Coombe Yarra Valley’s Privacy Policy (which can be found here).

22. Coombe Yarra Valley may amend these Terms and Conditions from time to time without notice to the Customer.
